Terms & Conditions

 

IMPORTANT: This agreement contains a binding arbitration clause and class action waiver. Please read carefully before joining the program.

 

This Ambassador Program Agreement (“Agreement”) is between you (“Ambassador” or “you”) and EVOL Chicago, operated by EVOL Collective LLC (“Company,” “we,” or “us”), and governs your participation in the EVOL Chicago Ambassador Program (“Program”).

 

By applying to the Program, you agree to these terms.

 

 

1. Program Overview

 

What you do: Promote EVOL Chicago products to your network using your unique referral code and/or affiliate link.

 

What you get: A welcome gift package, additional gifts as you reach sales milestones, and commission on qualifying sales once you reach our top tier (see Section 6). You also receive a personal discount code for your own orders.

 

Relationship: You are an independent contractor, not an employee. You cannot make commitments on our behalf.

 

 

2. Eligibility & Requirements

 

To participate, you must:

 

- Be at least 18 years old

 

- Have a valid payment account (for commission payouts, if/when you reach the commission tier)

 

- Follow FTC disclosure requirements (see Section 3)

 

- Keep your account information current, including payment details

 

- Follow all program rules and applicable laws

 

Important Email Notice

 

Program notifications are sent from Buzzbassador at noreply@buzzbassadorapp.com or noreply@app.buzzbassadorapp.com, as well as from evolchicagomarketing@gmail.com. You must whitelist these addresses to ensure you receive important updates about your account, gifts, commissions, and program changes. Emails sent to spam/junk are still considered delivered, and you’re responsible for any missed communications.

3. FTC Disclosure Requirements

 

The FTC requires you to clearly disclose your relationship with us. You must:

 

For social media posts:

 

- Include a clear disclosure such as #EVOLpartner, #EVOLambassador, #sponsored, or #ad in a clear and conspicuous way

 

- Place disclosures where they can’t be missed (not buried in hashtags)

 

- Make disclosures in the same language as your post

 

- Include disclosures in videos/stories, not just descriptions

 

For in-person/direct referrals:

 

- Verbally disclose that you earn rewards or commission when sharing with friends/family

 

- Be honest about your experience with our products

 

- Never make false or misleading claims

 

Remember: “clear and conspicuous” means your audience should easily notice and understand that you have a relationship with us.

 

 

4. How to Promote

 

You have two ways to track referrals:

 

1. Affiliate link (recommended):

 

- Your personalized link automatically applies the customer discount and tracks the sale

 

- Works even if your code isn’t entered at checkout

 

- Most reliable tracking method — protects against missed credit

 

- Best for: bio links, posts, stories, emails, swipe-ups

 

2. Referral code:

 

- Your unique code that customers enter at checkout for their discount

 

- Great for casual conversations, DMs, or verbal sharing

 

- May not track if a sitewide sale overrides it, a browser extension injects a different code, or another promotion takes precedence

 

Important: Both methods count your referrals, but we strongly recommend using your affiliate link whenever possible. Your link acts as a backup so you get credit even if a code isn’t applied at checkout.

 

Where you can promote:

 

- Social media profiles and content

 

- Personal blog or website

 

- In-person to friends, family, and network

 

- Direct messages to people you know

 

- Email to your personal contacts

 

As long as someone genuinely finds EVOL through your personal efforts and uses your code or link, the referral counts — including word-of-mouth.

 

 

 

5. Program Rules

 

Do:

 

- Share authentically with people in your genuine network

 

- Be honest about your experience with our products

 

- Respect other ambassadors

 

- Track your referrals properly using your code or link

 

Don’t:

 

- Use your own code or link to place personal orders (use your personal discount code instead)

 

- Post your code on EVOL’s social media pages

 

- Submit your code to coupon/deal sites (RetailMeNot, Honey, SimplyCodes, Rakuten, CouponCabin, Slickdeals, etc.)

 

- Mass-distribute your code to strangers or bulk lists

 

- Run paid ads without our written permission (Google, Facebook, Instagram, TikTok, etc.)

 

- Misrepresent your relationship with us

 

- Sell products at events without written permission

 

Note on coupon-site leaksWe monitor coupon sites for leaked codes. If your code is found on one, we’ll immediately replace it with a new code and delete the leaked one. This protects you from unauthorized use and keeps tracking accurate. Your affiliate link stays the same, and your new code appears in your Buzzbassador dashboard.

 

 

 

6. Tiers, Gifts & Commission

 

The Program is tier-based. Your tier is determined by the number of qualifying sales you drive:

 

- Tiers 1–3 (0–14 sales): You earn gift rewards, not commission. You receive a free EVOL gift when you reach 5 sales and again at 10 sales.

 

- Top Tier (15+ sales): Commission turns on, and you earn commission on every qualifying sale you drive from that point forward.

 

Gift claims are sent by email with a link to redeem. We choose the gift contents at our discretion, and gift availability may change.

 

Commission (Top Tier only)

 

Rate: 5% of net sales (after discounts, taxes, and shipping). Commission rates are subject to change per Section 8. Commission applies only after you reach the Top Tier and only to qualifying sales made while you are in the Top Tier.

 

Qualifying purchases

 

- Customer uses your code at checkout OR clicks your affiliate link

 

- Payment is successfully processed

 

- Order is not cancelled or returned

 

- Sale results from online or in-person referrals you made

 

Processing period

 

- Commissions enter a 14-day processing period after the sale

 

- This protects against returns and refunds

 

- Your commission becomes payable only after this period ends

 

- Example: a sale on January 1st becomes payable after 14 days

 

Payment

 

- Paid monthly in USD, approximately on the 1st of each month

 

- Payment method: cash via our payout provider OR store credit, at our discretion

- Only commissions that have completed their processing period are included

 

- You’re responsible for payment-processor fees and taxes

 

Payment method requirementsFor cash payouts you must keep valid payment information in your Buzzbassador account. If we can’t pay you due to incorrect or missing details, we’ll try to notify you; if you don’t update within 90 days of commissions becoming payable, those commissions may be forfeited. We’re not responsible for payments sent to incorrect accounts due to your error.

 

Forfeiture for violationsCommissions are automatically forfeited if they result from fraudulent or prohibited activity, including sales from codes leaked to coupon sites, self-referrals, or any violation of these terms. We may withhold all pending commissions if fraudulent activity is suspected or confirmed.

 

Tracking your earningsThe “My Earnings” page shows only your paid transaction history. It won’t show commissions still processing, due-but-unpaid, or pending payouts. Contact us with questions about pending commissions.

 

Exclusions — no commission on:

 

- Orders you place using your own code or link (self-referrals)

 

- Orders after your termination

 

- Cancelled or returned orders

 

- Purchases from unauthorized paid advertising

 

- Purchases from codes leaked to coupon sites

 

- Improperly tracked orders

 

- Any qualifying sales made before you reached the Top Tier

 

Your personal discount code

 

Separate from your shareable code and link, you receive a personal discount code for your own orders. It offers a higher discount than your shareable customer code and is limited to one use per month. Orders you place with your own shareable code or link do not count toward your tier and earn no commission — always use your personal discount code for your own purchases.

 

 

 

7. Campaigns

 

What are Campaigns?

 

We may invite you to special Campaigns with specific goals and rewards beyond your regular tier rewards.

 

Campaign invitations:

 

- We choose which ambassadors to invite at our sole discretion; not everyone is invited to every Campaign

 

- If invited, participation is optional

 

- Invitations are sent by email from noreply@app.buzzbassadorapp.com or noreply@buzzbassadorapp.com

 

Campaign types:

 

- Sales goals: reach a sales amount or number of referrals

 

- Social media goals: post specific content on designated platforms

 

Campaign details:

 

- Each Campaign has a start date and either an end date or is open-ended

 

- Fixed end date: only activity between start and end counts. Open-ended: activity counts until we manually end it

 

- Each invite links to full details, requirements, and rewards

 

Campaign rewards:

 

- Set by us; may be paid as cash or store credit

 

- Subject to the same payment rules and forfeiture conditions as commissions

 

Sales campaign requirements:

 

- Your code/link must be used properly (no coupon sites, no self-orders)

 

- May require specific products; progress is tracked automatically

 

Social media campaign requirements:

 

- Must post on the specified platform and content type

 

- May require specific @mentions, #hashtags, or keywords

 

- Must manually submit your post via the Campaign page during the Campaign period; missing the deadline forfeits the reward

 

Content usage rightsBy submitting content for a social media Campaign, you grant us an unlimited, irrevocable, worldwide, royalty-free, and perpetual license to use that content for any purpose, including marketing materials, our social channels, and paid advertising.

 

Submission & approval:

 

- We may reject submissions that don’t meet requirements; you’ll get feedback and can resubmit until accepted or the Campaign ends

 

- Each member can participate once per Campaign

 

- We’re not responsible for missed Campaign emails in spam/junk, and may reject rewards for fraudulent activity

 

 

8. Important Legal Terms

 

Program changes: We reserve the right to modify your referral code, commission rate, discount percentage, tier thresholds, gift offerings, or any other program terms at any time, with or without notice — including immediately changing your code if it’s found on coupon sites. We may remove ambassadors at our discretion (see Section 9). Continued participation after changes constitutes acceptance.

 

Intellectual property: You don’t gain any rights to our trademarks, logos, or content.

 

Confidentiality: Keep any non-public information about the Program confidential.

 

Liability limit: Our maximum liability is limited to commissions earned in the past 12 months.

 

Indemnification: You’ll defend us from claims arising from your participation in the Program.

 

No warranties: The Program is provided “as is” without warranties. We don’t guarantee any specific results or earnings.

 

 

 

9. Term & Termination

 

- Either party can end this agreement at any time with written notice

 

- We may terminate immediately for violations or fraudulent activity

 

- Earned commissions will be paid after termination, subject to our verification

 

Our right to remove ambassadors: We may remove you at any time, with or without notice, including for: suspected or confirmed violations; lack of participation; failure to respond to our communications; insufficient performance; conduct that may harm our brand; or any other reason at our sole discretion. Upon termination you must immediately stop using your code and links and stop representing yourself as our ambassador.

 

 

 

10. Dispute Resolution

 

- First step: try to resolve disputes informally by contacting us at evolchicagomarketing@gmail.com

 

- Arbitration: if we can’t resolve informally, disputes will be settled by binding arbitration in Chicago, Illinois under AAA rules

 

- No class actions: all disputes must be brought individually, not as part of a class action

 

- Governing law: this Agreement is governed by Illinois law

 

 

 

11. General Terms

 

- We may update these terms; continued participation means acceptance

 

- This is the complete agreement between us

 

- If any provision is invalid, the rest remains in effect

 

- You cannot transfer this agreement without our permission

EVOL CHICAGO AMBASSADOR PROGRAM Enhanced Terms & Conditions Addendum

 

 

This addendum incorporates recommended protections for EVOL Chicago and should be integrated into the full Ambassador Program Terms & Conditions. Review with legal counsel before publication.

 

Brand Representation & Community Standards

 

Participation is a privilege. Ambassadors represent EVOL Chicago online and in person and must conduct themselves professionally. EVOL Chicago may suspend or terminate participation if an Ambassador engages in conduct that, in EVOL Chicago's reasonable business judgment, harms or could harm the Company, its artists, sponsors, partners, customers, employees, or community, including harassment, discrimination, fraud, illegal activity, unsafe conduct, substance abuse while representing EVOL, or knowingly false public statements.

 

Social Media & Brand Usage

 

Ambassadors may not present themselves as employees, owners, official spokespersons, or authorized representatives without written authorization. EVOL Chicago may require modification or removal of content that is inaccurate, misleading, offensive, unsafe, or inconsistent with brand standards.

 

Artist & Intellectual Property

 

All artwork, logos, graphics, photography, videos, trademarks, marketing materials, and artist-created designs remain the exclusive property of EVOL Chicago and/or the respective artist. Ambassadors may not reproduce, alter, manufacture, commercially exploit, use to train AI systems, or create derivative works without written permission.

 

Festival & Event Conduct

 

Ambassadors must follow all venue rules, festival policies, and EVOL procedures and help maintain a safe, welcoming environment. EVOL may immediately remove an Ambassador from any event when necessary to protect safety, operations, or partnerships.

 

Photography, Video & Content License

 

Ambassadors grant EVOL Chicago a perpetual, worldwide, royalty-free license to use their name, image, likeness, voice, photographs, videos, and submitted content for marketing and promotional purposes without additional compensation.

 

No Guaranteed Earnings

 

Participation does not guarantee commissions, gifts, campaigns, collaborations, free merchandise, invitations, or income. Results depend upon the Ambassador's participation and promotional efforts.

 

Force Majeure

 

EVOL Chicago is not responsible for delays or cancellations caused by weather, venue closures, government actions, labor disputes, public emergencies, pandemics, supply chain issues, or other events beyond its reasonable control.

 

Termination

 

EVOL Chicago may suspend or terminate participation immediately for violations of the Agreement or whenever continued participation is not in the best interests of the Company, its artists, partners, sponsors, customers, or community.

 

Ambassador Handbook Recommendation

 

Maintain a separate Ambassador Handbook covering brand standards, customer interaction, event etiquette, FTC compliance, safety, photography, dress code, and community expectations. Is this something we should consider?

The EVOLution Of Love

It all started in 2014.

Back then, weekends meant dancing till sunrise in Chicago, and summers meant hitting every festival we could reach. House music was exploding. You could feel it in the air—this undeniable wave of sound that made people move, connect, and let go.

But what really struck me was hearing it everywhere—restaurants, clubs, hotels, stores—even internationally. It was global. It was unifying.

But no one really knew where it all came from.

That’s what got to me.

House music was born here, in Chicago.

It was the city’s gift to the world—and yet, the roots were so often overlooked. I wanted to change that. I wanted to create something iconic that honored the origin, the energy, and the people. Something that gave this sound the recognition it deserved.

So in January 2014, we created the first “We Love House Music” design—our own remix of the Chicago flag, layered with the city skyline and a message that said it all. It wasn’t just for show. It was a symbol of unity. A tribute to the heartbeat of the city and the culture that raised us.

Then, in April of that same year, everything shifted.

We lost Frankie Knuckles, the Godfather of House Music. It was devastating, but what I’ll never forget is how the community came together. At his memorial in Millennium Park, we brought something to share with everyone. One logo. One message. Just love.

And that’s when EVOL Chicago was born.

From there, we built slow and steady—one design at a time, one drop at a time. What started with friends and family grew into something bigger than I ever imagined. We teamed up with artists like Erika Lizette, JDubz, Mike Swanson, and others to create pieces that didn’t just look good, but told stories. Personal stories. Powerful stories.

EVOL isn’t just LOVE spelled backward.

It’s about how love transforms.

How it moves through sound, art, energy—and how it connects people who might never have crossed paths otherwise.

Now, ten years later, I look back at everything we’ve built together—the late nights, the long drives, the festivals, the fits, the family—and I feel nothing but gratitude.

EVOL is still here.

Still growing.

Still evolving.

It’s the EVOLution of Love—and it’s just getting started.
